References herein to "You" and/or "Yours" mean the individual or party leader making this booking and all persons named in a booking on whose behalf the individual or party leader making the booking has been authorised to act. References herein to "Us" and/or "we" means spa-ireland.com
The following terms and conditions together with other property specific information contained on our website form the basis of Your agreement with Spa Ireland & the owners of the properties, spas and/or other services (hereinafter referred to as "Third Party Suppliers") featured on our website. Please read them carefully as they set out each party's respective rights and obligations. By using this site, You acknowledge Your assent to these terms and conditions. If You do not agree with any part of the following terms and conditions, You must not use this site.
Special Note: We act as agents for the Third Party Suppliers we feature. When making Your reservations, we do so as agents for the Third Party Suppliers with whom You will have a contract. When we deal with You as a Third Party Supplier's agent, we have no contractual liability for the services, which You have purchased.
How to Book
Once you have chosen the accommodation and/or spa option, including treatments (hereinafter referred to as "Selected Services") that you wish to book please follow the online booking instructions. In the event a reservation may not be made automatically on our site please contact us by email – firstname.lastname@example.org. We will then check the price and availability of the Selected Services which You have elected to book.
If your booking is made automatically online, all terms and conditions relating to the third party supplier you book will apply, including cancellation policies. If Spa Ireland make the booking on your behalf the following applies. In order to process Your booking a deposit of 10% of the total cost of Your chosen Selected Services must be paid at the time of booking. The balance of the cost of Your Selected Services must be paid directly to the Third Party Supplier together with the cost of any additional services purchased during Your stay at the hotel and/or spa premises. Payment of your deposit to us can be made by way of Credit Card – Visa Cards or MasterCards are accepted by us (NOTE an administrative fee of €5.00 per booking will be charged to You if You pay by Credit Card or Laser, this will be fully itemized on Your booking quotation and confirmation.) For bookings which do not include accommodation (i.e., treatment only bookings) an additional handling fee of €5.00 per booking applies. This is non refundable in the event a treatment booking is cancelled by You; however if You need to change the dates of Your booked treatment we will do everything we can to facilitate this. We will need You to provide Your card number, expiry date, issue number and full name as it appears on the card and the card billing address. Upon receipt of Your Booking Offer together with the appropriate Booking Deposit, we shall subject to availability, confirm Your Selected Services either automatically within the booking process or via confirmation email if there are elements which are not immediately confirmed. Our confirmation email will detail all accommodation; services; and products booked by Spa Ireland on Your behalf. Contact us immediately on 01 707 8617 if any information which appears on the confirmation email or any other document appears to be incorrect or incomplete as it may not be possible to make changes later. We regret we cannot accept any liability if we are not notified of any inaccuracies in any document within five days of our sending it to You.
For all bookings a contract shall come into existence once You have given us Your Booking Order, we have confirmed Your booking to You verbally or by email and You have authorised us to take payment of Your Booking Deposit using Your credit or debit card details. This contract and all matters arising out of it is governed by Irish law and is subject to the exclusive jurisdiction of the Irish courts.
We have done our best to ensure that all descriptions, information and prices contained on this website are correct and accurate in accordance with the latest information available at the time of publication. Regrettably however errors do occur and we reserve the right to correct these errors. The photographs, and descriptions featured are there to give a general impression. Room descriptions are given as examples of what is available. They do not necessarily represent the type of accommodation which will be allocated to You on arrival as many rooms are individually built with slightly differing characteristics. Description of spa programmes is indicative only. Specific treatments may vary, although every effort has been made to describe them as accurately as possible, there may be changes in the type and number of treatments which occur and which are beyond our control. Where we are aware of these changes we will endeavor to inform You.
Invitation to Treat
All the Services sold through this web-site are NOT an offer by us to sell any Service, but an invitation to You to make an offer to the third party supplier, the third party supplier is free to accept or reject these offers. You will receive an email confirming the contract if You are purchasing from the website.
We grant You a limited, non-transferable licence to use this site in accordance with these Terms and Conditions of Use. You may only use this site to make legitimate reservations or purchases and shall not use this site for any other purposes. This site and content provided in this site may not be reproduced in any way without our written consent. Unauthorised use of this site may violate applicable copyright, trademark or other intellectual property laws or other laws. You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that violate any law. In addition, You are prohibited from posting or transmitting any information which (a) infringes the rights of others or violates their privacy or publicity rights (b) is protected by copyright, trademark or other proprietary right unless with the express written permission of the owner of such right, (c) contains a virus, bug or other harmful item, or (d) is used to unlawfully collude against another person in the restraint of trade or competition. You shall be solely liable for any damages resulting from any infringement of copyright, trademark or other proprietary right, or any other harm resulting from your use of this site. We reserve the right to take such action as considered necessary, including issuing legal proceedings without further notice to you, in relation to any unauthorised use of this website.
You may not establish and/or operate links to this website without our prior written consent. We may withdraw such consent at any time at our sole discretion
Should You wish to make any changes to Your confirmed Selected Services You must notify either the property you have chosen or us in writing as soon as possible. Whilst we will endeavor to assist, we cannot guarantee we will be able to meet any such requests. Where we can, an amendment fee of €10 per person/per booking will be payable together with any costs incurred by ourselves and any costs or charges incurred or imposed by the hotel or spa property owner or any other suppliers.
Should You have to cancel Your booking, You should immediately inform us via email your notice of cancellation will only be effective when we receive it via email. Cancellation fees vary by hotel and/or spa property and will be payable to the property directly. You agree that Spa Ireland may share your Laser or credit card details with the hotel and/or spa property in the event cancellation or no show fees apply and that the hotel and/or Spa Property is entitled to debit your credit or Laser card for the relevant amount in line with their own terms & conditions. Please remember that your original booking deposit is totally non refundable.
Except where otherwise expressly stated in these Terms and Conditions we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by or You otherwise suffer any damage or loss as a result of "force majeure". In these Terms and Conditions, "force majeure" means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.
Please let us know of any special requests You may have at the time of booking. We will do our best to pass any reasonable requests on to the relevant Third Party Supplier concerned though we cannot guarantee any request will be met. Failure to meet a special request will not constitute a breach of Your contract.
It shall be Your responsibility to disclose to us any physical or mental condition of You or any member of Your party which may be relevant. We cannot accept liability for the unsuitability of any Selected Service where You fail to notify us of a Special Need. We reserve the right to decline to provide a service to a person with Special Needs where in our opinion that service would be inconsistent with the special needs of that person.
Passports, Visas and Health Requirements
It is Your responsibility to ensure that You are in possession of all necessary travel and health documents before departure. All costs incurred in obtaining such documentation must be paid by You.
We shall have no liability for any death or personal injury unless this results from our negligence or our employees' negligence (providing they were at the time acting in the course of their employment with us). You must take all necessary steps to safeguard Your personal property. We accept no liability in respect of damage to, or loss of, such personal property except where it results from our negligence or our employee's negligence (providing they were at the time acting in the course of their employment with us). As we act only as agent for the Third Party Supplier we cannot accept any liability for any act(s) or omission(s) of the Third Party Supplier or anyone representing, or employed by, the Third Party Supplier. Further, we cannot accept any liability for any shortcomings or defects with or in any property and/or spa centre as all properties and/or spa centres are within the sole control of the owners of same.
Your Liability to us
When You book with us, You accept full responsibility for any damage or loss caused by You or any member of Your party. Full payment for any such damage or loss must be paid direct at the time to the property/spa owner or manager or other supplier. If You fail to do so, You will be responsible for meeting any claims subsequently made against us (together with Spa Ireland's and the other party's full legal costs) as a result of Your actions. You undertake to behave with propriety and in such a manner as in no way to cause distress, damage, danger or injury to other clients, property, our employees and/or any third party. The contract of any client in breach of this clause shall be terminated forthwith and we, nor the property owner or other supplier concerned shall have no further contractual obligations to You. No refunds will be made and we, nor the property owner or other supplier will not pay any expenses or costs incurred as a result of the termination.
We are always very interested in hearing Your comments on the Selected Services of which You have availed and we will occasionally invite Your feedback by way of a questionnaire. The accommodation and services we feature are provided by the individual Third Party Suppliers who are responsible for the properties and or provision of services including spa treatments. Clients' complaints will be forwarded to the individual Third Party Supplier and dealt with according to their instructions. In the event of a complaint You should in the first instance report Your complaint the hotel or spa manager whilst You are on the premises of the Third Party Supplier. If the matter cannot be resolved on the spot and You wish to take it up on Your return, we must be notified in writing within 28 days of Your return date and we will do our utmost to assist You in bringing the matter to a speedy and acceptable conclusion.
Our agreement with our Third Party Suppliers which feature on this site relates to accommodation & spa treatment prices and in all cases we have negotiated Best Public Available Rate (a rate which is less than or equal to the best available rate quoted by the hotel and/or spa on the day of booking).
